This Privacy Notice explains how Binks and our group companies (“we”, “us”, “our”) collect, use, and share personal data. This Privacy Notice applies to our processing of personal data about our customers, potential customers, and visitors to our website. Our website may contain links to third party sites that are not owned or controlled by us. We are not responsible for the privacy practices of these third parties, and we encourage you to review the privacy notices posted on any sites with which you interact. We do not market our products or knowingly collect, sell, or share personal data from minors under the age of 16.

1. Who we are

Binks is a leading global manufacturer of products and systems for the supply, application and curing of sprayed materials including paints, coatings, powders, mastics and bonding materials. We operate the global brands of BGK, Binks, DeVilbiss, Hosco, ms, Ransburg, and Intellispray. For the purposes of the processing described in this Privacy Notice, Binks is the controller of your personal data.

2. Types of personal data we process

“Personal data” means information that can identify an individual, either directly or when combined with other information. We obtain personal data directly from you, if you provide it, or from your device via cookies and similar technologies.

If you make a purchase or set up an account with us, we may collect the following types of personal data:

• Identifiers such as real name, postal address, phone numbers, online identifiers, IP address, email address, username and password
• Purchase history
• Credit card information
• Any phone number used to call our customer service number
• Inferences drawn from personal data for marketing purposes

When you visit our website, we may process the following types of data:

• Your Internet protocol (IP) address
• Browser type and version
• Time zone setting
• Browser plug-in types and versions
• Operating system
• Information about your visit to our website, including:
  • Pages you viewed
  • Products you viewed or searched for

  • Page interaction information (such as scrolling, clicks, and mouse-overs)
• If you arrived at our website via a link hosted on another website, the URL of the website from which you were referred

3. Our purposes and legal bases for processing personal data

Our purposes for collecting personal data include:

• Providing quotations and sales proposals

We may share personal data within our corporate group, which means our subsidiaries, our ultimate holding company and its subsidiaries. We have not sold your personal data or shared your personal data for targeted advertising purposes.

We may also share personal data with the following types of organizations:

• Business partners, suppliers and sub-contractors for the performance of any contract we enter into with you
• Advertisers and advertising networks, but only for our own advertising purposes
• Analytics and search engine providers that assist us in the improvement and optimisation of our site
• Credit reference agencies for the purpose of assessing and verifying your credit score

5. How long we store personal data

We store personal data for as long as necessary to fulfil the purposes for which we collected it.

Where we process personal data in relation to a sale or quotation, we will store the personal data for six years following the end of our contractual relationship with you.

If we process personal data for marketing purposes, we will retain the personal data until you notify us that you no longer wish to receive marketing from us.

6. International data transfers

We may transfer personal data to organizations outside of your country of residence. We have an International Data Transfer Agreement (IDTA) between our entities and affiliates, which is designed to help protect your personal data in such transfers.

• Right to restrict processing: You have the right to request that we restrict how we process or disclose your personal data; 
• Right to object: You have the right to object to how we process your personal data; 
• Right to data portability: You have the right to request a portable, machine-readable copy of your personal data, and may also request that we transfer your personal data to another controller, where applicable. 
• Right to submit a complaint: You have the right to submit a compliant regarding our processing of your personal data to the relevant authority. 
• Right to representative: You have the right to nominate another person to exercise your rights on your behalf. We will take steps to verify that your agent has been authorized to make a request on your behalf, and we may ask for a signed written authorization or a copy of a power of attorney.

• We might need additional information to verify your identity or clarify your request.
• We will respond without undue delay and aim to facilitate your request within one month.
• If we need more time, we will inform you within the initial one-month period.
